These Terms of Use ("Terms") govern your access to and use of the FastBreak mobile application (the "App") and the website at gofasting.app (the "Website"), provided by Bebra Apps ("we," "us," or "our").

By downloading, installing, or using FastBreak, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

FastBreak is an intermittent fasting companion app that provides fasting timers, weight and body measurement tracking, progress photo storage, food logging, and related wellness features. The App is available for iOS (iPhone) and supports premium features through optional paid subscriptions.

2. Eligibility

You must be at least 18 years of age to use FastBreak. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Health Disclaimer

FastBreak does not provide medical advice, diagnosis, or treatment. The App is a tracking and informational tool only. All content, features, and suggestions within the App are for general informational and wellness purposes and should not be construed as professional medical advice.

You should always consult a qualified healthcare provider before starting any fasting regimen, diet, or exercise program, especially if you have any pre-existing health conditions or are taking medication.

FastBreak is not suitable for and should not be used by:

  • Pregnant or breastfeeding individuals
  • Persons under 18 years of age
  • Individuals with a history of eating disorders
  • Individuals with type 1 diabetes

You acknowledge that you use the App at your own risk and that we are not responsible for any health outcomes resulting from your use of the App.

4. User Accounts

FastBreak does not require you to create an account. Your data is stored locally on your device and, if you choose to enable iCloud sync, in your personal iCloud account. You are responsible for maintaining the security of your device and iCloud account.

5. Subscriptions and Payments

5.1 Premium Subscription

FastBreak offers optional premium features through paid subscriptions. Subscription plans include monthly, yearly, and lifetime options. Prices are displayed in the App before purchase and may vary by region.

5.2 Billing

All purchases are processed through the Apple App Store. By purchasing a subscription, you agree to Apple's terms and payment practices. Your payment method on file with Apple will be charged at the time of purchase and, for recurring subscriptions, at the beginning of each renewal period.

5.3 Auto-Renewal

Monthly and yearly subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings. Lifetime subscriptions are a one-time purchase and do not renew.

5.4 Refunds

Refunds are handled by Apple in accordance with the App Store refund policy. We do not process refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.

5.5 Free Trial

If a free trial is offered, it will be clearly identified in the App along with the subscription terms that will apply after the trial ends. If you do not cancel before the trial period expires, your subscription will begin and your payment method will be charged.

6. User Responsibilities

When using FastBreak, you agree to:

  • Use the App only for its intended purpose as a personal wellness tool
  • Provide accurate information when entering health data
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any manner that could damage, disable, or impair its functionality
  • Not use the App for any unlawful purpose
  • Not redistribute, sublicense, or resell the App or any of its content

7. Intellectual Property

All content, features, functionality, design, graphics, trademarks, and other intellectual property in the App and Website are owned by Bebra Apps and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works based on the App.

8. Your Data

Your data is your own. FastBreak stores your data locally on your device and, if you enable iCloud sync, in your iCloud account. We do not have access to your personal health data. For full details on how we handle information, please refer to our Privacy Policy.

9. Third-Party Services

The App may integrate with third-party services including Apple HealthKit, Apple CloudKit (iCloud), Firebase, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

FastBreak is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the App.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Bebra Apps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising out of or related to your use of or inability to use the App.

In no event shall our total liability to you for all claims arising from or related to the App exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bebra Apps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using FastBreak at any time by uninstalling the App. We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your license to use the App is revoked. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to the Health Disclaimer, Limitation of Liability, and Indemnification sections.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective date" at the top of this page. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bebra Apps regarding your use of the App and supersede all prior agreements and understandings.
